How a confused employer finally figured out employee discipline and termination.

Instead of seniority, other companies look at their company operations. First, when you're firing for insubordination, you should lay off the day after the 3-day suspension whether this is Friday or not. (See Chapter 7 for how to sack for gross misconduct.) A reprimand notice is mostly the first step in any legal and proper employee firing process. Wish the jobholder good luck in all future endeavors, and that will be the end of it. By not handling the jobholder properly, your problems will only get worse.

Even if your employee handbook or collective bargaining agreement says you can fire a probationary worker for any reason, be sure an opportunistic legal counsellor will take her case. But once the jobholder gets wind that you are trying to layoff them, they may rely on some standard tricks to keep their job.
