How to fire an At will employee Step 2: Discuss it with the At will employee. It's not any secret she and I had our differences about her job performance [or conduct.] We followed all the firm's policies and procedures, but it just didn't work out. At the end of the lay off meeting, you have covered all bases with the employee so both you and the worker should fully understand why the dismissal occurred. As you know from Chapter 4, you give your standard dismissal package for a low-risk dismissal. Finally, there'll be a few other tasks to complete. Although I've shown you how to fight a claim, I recommend against it under most circumstances. And, when you lose the litigation, the judge may force you to pay for the ex-employee's legal counselor as well. 7) Follow-up any extra eyewitnesses and copy documents the accused worker says support his story. If the employee's last day is the day you are speaking with them, have that final paycheck ready for them to take home right away. By terminating personnel the right way, many small businesses will increase their success and find that their workplace grows with the right workforce.
