You must remember embezzlement is a serious offense and sacking that person is usually the only move you can make. Except for the signature, the difficult individual rarely fills out the bottom part. It should also include whether the at will worker is eligible for rehire and any benefits that he or she may or may not still receive after layoff. And it applies to union, nonunion, exempt and nonexempt employees. It should make clear your previous attempts to correct the employee with dates, a statement communicating the worker is dismissed effective on a date, and any final pay and severance packages. If you decide to terminate an employee under FMLA, your method is the same as any other termination. I hate running to a legal counselor and paying at least $1,000 to answer this question for every new "tricky" dismissal. In the employee reprimand you should state what the expected performance is and what the consequences will be should the employee fail to meet it.
