How a confused employer finally figured out employee discipline and termination.

Although this may be mentally exhausting to you as the Personnel supervisor or entrepreneur, you should respect each worker as well as their privacy. Employee subordination is the willful refusal by a worker to follow your valid and reasonable order. By following these general standards, you can create an effective layoff letter.

*Did the jobholder have a clear understanding of what your expected of her or him while employed? Its main purpose is to document and clarify the grounds for the lay off, when the firing takes effect and what final benefits and pay the firm owes the worker. Her legal adviser tells you the "real" reason you fired her is because the firm expected her to sleep with the CEO or the VP of manufacturing to keep her job. If the employee performs illegal acts, is violent or jeopardizes the safety of other employees, you have the right to terminate them right away. But knowing how to separate someone properly is important to the future success of the business. Being fair means you'll layoff them only for a legitimate reason and will inform them why. (Undoubtedly, when the company already has policies and methods about dismissals, these supersede the list below.) However you can separate the worker for reasons outside their protective status. Any violation of these conditions makes up employment misbehavior. For example, address the notice to the employee, not the supervisor of the department or the human resources manager. As you know, he can still sue you, but you have cut dramatically your risk of losing. Finally, if something in the disgruntled employee's life is depressing her, now and then sending her off to a professional seminar or convention can work wonders for her spirits.
